Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 15/12/2015 (1) Heard.

(2) Learned counsel appearing for the petitioner submits that the petitioner has been transferred from the Primary School Saradhunavagaon, Vikas Khand Charama to Primary School Barkot, Vikas Khand, Koyalibeda declaring her as surplus teacher. He further submits that there is no other teacher and the Head Master of the school is also going to retire in the month of January, therefore, she may be permitted to make a representation before the Collector, North Baster, against the order of transfer dated 31.10.2015, to which counsel for the State has no objection.

(4) Prayer appears to be fair and reasonable.

(5) The petitioner is permitted to make a representation before the Collector, North Baster within ten days from today. If such representation is made by the petitioner before the said authority, the authority shall consider and decide the same on its own merit and in accordance with law preferably within a period of six weeks from the date of receipt of representation of the petitioner. (6) For a period of six weeks, the effect and operation of the impugned transfer order dated 31.10.2015, in respect of the petitioner shall remain stayed.

(7) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
