This is first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 82 of 2020, registered at Police Station- Shankargarh, District - BalrampurRamanujganj (C.G.), for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substance Act, 1985. 3.

It is submitted by the learned counsel for the Applicant that the applicant has been falsely implicated. He has not committed any offence. The Applicant is in jail since 03.08.2020. Charge-sheet has been filed. Trial is not making progress. Therefore, it is prayed that the applicant may be granted bail.

On the other hand, learned counsel for the State opposes the bail application and submits that the Applicant is not entitled for grant of bail.

I have heard the learned counsel for both the parties and perused the case diary.

38 numbers of cannabis plants were seized from the courtyard of the house of this Applicant. Hence, this case.

Considered on the submissions. As this Applicant does not have any criminal antecedent and further now the case is pending for trial after filing of the charge-sheet, which is likely to get delayed, therefore, I am inclined to allow this application.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
