The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 48/2015 registered in Police Station Chalgali, Dist. Balrampur for offence punishable under section 354 of Indian Penal Code and Section 8 Protection of Children from Sexual Offences, 2012.

As per the prosecution case on 3/09/2015 while the prosecutrix was coming from the school at that time applicant came there caught hold of her and kissed her and thereafter pressed her breast and after alarm having been raised by the prosecutrix other persons came down and applicant fled away from the scene.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and charge sheet having been filed, therefore applicant may be released on bail.

Learned State opposes the prayer for grant of bail. 5.
Having considered the facts and circumstances of the case,
perused the statement of the prosecutrix, charge sheet having been filed, applicant is in jail since 5/09/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
