This is first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 26 of 2021, registered at Police Station-G.R.P. Raipur, District - Raipur (C.G.), for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substance Act, 1985.

It is submitted by the learned counsel for the Applicant that the applicant has been falsely implicated. He has not committed any offence. The Applicant is in jail since 04.05.2021. Charge-sheet has been filed. Therefore, it is prayed that the applicant may be granted bail.

On the other hand, learned counsel for the State/non-applicant opposes the application submitting that the applicant is resident of Orissa, therefore, if he is granted bail, he may not be available for the trial. Hence, the application may be rejected. 5.

I have heard the learned counsel for both the parties and perused the case diary.

G.R.P. Raipur has made a seizure of 10.100 kg cannabis from the possession of this Applicant. Hence, this case. 7.

Considered on the submissions. As the charge-sheet has been filed and now the case is pending for the trial which is likely to take some time, therefore, I am inclined to allow this application. 8.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
