Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 24-61. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.

2. The applicant has been arrested in connection with Crime No. 210/2018 registered in police station Basna, Distt. Mahasamund (CG) for offence punishable under Section 307 of IPC.

3. Perused the case diary.

4. Prosecution story in brief is that on 22-5-2019 at about 8.00 pm, the applicant caused injury on the head and abdomen of the complainant by a knife as a result his intestine exposed.

5. Counsel for the applicant argued that the applicant is innocent and falsely implicated. He further submits that the applicant is a 70 years old man and evidence is not being recorded in the trial Court. Hence he may be released on bail.

6. On the other hand, the State Counsel opposed the bail application.

7. Looking to the above mentioned facts and circumstances of the case, looking to the material available on record, this Court is not inclined to grant bail to the applicant.

8. Consequently, the MCRC is rejected.

9. However, trial court is directed to expedite the trial and dispose of the same as early as possible.
