The writ petition has been preferred by the Gram Panchayat seeking a direction to the Collector, Balrampur-Ramanujganj,

to decide its representation by which the Gram Panchayat had sought assistance from the Collector to provide necessary protection/assistance in the on going construction of new Panchayat building.

The prayer has been made on the ground that some villagers are obstructing construction, therefore, the administration should come forward to allow the construction being raised in an uninterrupted manner.

The petitioner has not disclosed as to whether there is any official interference or any interference by any officer of the Department in his personal capacity. The petitioner has not named the villagers also who are obstructing in raising the construction. The allegations in the petition are vague. If the obstruction is made by some villagers in their individual capacity, the petitioner has remedy to prefer duly constituted suit seeking temporary or permanent injunction. 5.
