The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 415/2015 registered in Police Station Balod, District Balod (C.G.) for offence punishable under section 307, 147, 148, 149 of Indian Penal Code.

As per the prosecution case on 5/09/2015 the applicant along with other co-accused has caused assault to one Charan Das who sustained injury on his body, therefore tried to kill said complainant and he was assaulted by way of knife.

Learned counsel for the applicant submits that complainant was in state of intoxication has urinated in the boundary wall of the Majar, therefore it resulted into scuffle and consequently the applicant has been falsely implicated in this case, therefore learned counsel prays for release of the applicant on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the statement of the victim Charan Das and statement of Pramod wherein main allegation of causing assault by knife

is on this applicant, therefore at this stage this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. However, liberty is reserved in favour of the applicant to revive bail application after examination of the victim/complainant.
