The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody since 15.04.2017 in connection with Crime No.72/2017 registered at Police Station : Sitapur, District Surguja (C.G.) for the offence punishable under Section 376(2) IPC and Section 5(I)/6 of POCSO Act.

Learned counsel for the applicant submits that the evidence adduced by the prosecution does not make out any case against the applicant. However, at this stage, purpose of filing this application would be served if direction is given to the trial Court to decide the trial itself as expeditiously as possible. He further submits that main evidence has been concluded.

State counsel has no objection to this proposition. 4.

In view of above, the application is dismissed as withdrawn directing the trial Court to conclude the trial as expeditiously as possible, preferably within a period of two months from the next date of hearing. It is the duty of counsel for the applicant to apprise this fact to the trial Court. 5.

Registry shall also forward the copy of this order to the trial Court.
