The issue involved in these writ petitions is regarding applicability of the provisions of the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (for short "the Act, 1996") to the petitioners entity. Similar issue has been raised in WPT No.4946 of 2011 and other writ petitions wherein this Court has already granted interim relief in favour of the petitioners.

Post these cases for final hearing along with WPT No.109/2016, WPC No.887/2014 & WPC No.39/2016 and other connected petitions.

In the meanwhile, it is directed that henceforth no recovery shall be made from the petitioners on account of payment of cess under the Act, 1996. However, the amount already recovered shall remain with the concerned respondent, if not paid. Sd/- Judge Nirala Prashant Kumar Mishra
