The applicant has preferred this second bail application under Section 439 of the Cr.P.C.. as he is arrested in connection with Crime No.855 of 2020, registered at Police Station Sarkanda, Dist.- Bilaspur C.G., for the offence punishable under Section 21, 22 of the NDPS Act.

Learned counsel for the applicant seeks bail to the applicant on the ground of delay in conclusion of trial as also for the fact that the applicant is languishing in jail since 14-9-2020.

Per contra, learned counsel for the State would oppose the bail application.

Considering the facts situation of the case and further considering the fact that the first bail application was dismissed on merits by a detailed order, this Court is not inclined to grant bail to the applicant.
