1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested in connection with Crime No. 591/2020 for the offence punishable under Section 366, 376 (2) (n) & 506of IPC, registered at Police Station- Basna, District- Mahasamund (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file afresh at an appropriate stage.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
