1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 149 of 2015 registered at P.S. Kartala, Distt. Korba (C.G) for the offence punishable under Section 420 IPC.

2. Case of prosecution, in brief, is that on 27.09.2015 a report was made that the applicant has received Rs.2500/- each from 10 lady members of Janani Mahila Association so as to provide them loan of Rs.50,000/- each under the Scheme of Chhattisgarh Khad Thatha Gramodyog and subsequently when the loan amounts were not disbursed, the report was made.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and no forgery has been committed. He further submits that the applicant is in jail since 22.10.2015 and the charge sheet has already been filed, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application.

Having regard to the nature of allegations and the fact that the charge sheet has been filed in this case and the evidences available in this case is documentary evidence in nature and also considering the fact that the applicant is in jail since 06.11.2015, I am inclined to release him on bail.

6. Accordingly, this application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. He shall also appear before the trial Court as and when directed by the said Court.
