(2) Learned counsel appearing for the State/respondents on instruction would submit that order dated on 23.11.2015 (Annexure P-2) passed by respondent No.2 i.e. Collector, Surguja transferring the petitioner will be withdrawn within a week. He would further submit that the order dated 23.11.2015 (Annexure P-1) passed by respondent No.2 i.e. Collector Surguja placing the
petitioner under suspension is appealable before the Divisional Commissioner (Revenue).
(3) At this stage, learned counsel appearing for the petitioner would submit that the petitioner may be permitted to withdraw this petition with liberty to prefer an appeal before the competent authority within 15 days from today.
(4) The prayer appears to be fair and reasonable. (5) The petitioner is permitted to prefer an appeal before the competent authority. If such appeal is filed within a period of 15 days from today, the concerned authority shall consider and decide the same in accordance with law and on its own merit within a period of 45 days from the date of receipt of the appeal of the petitioner.
(6) With the aforesaid observation, the writ petition stands disposed of. No order as to cost(s).
