1. The matter is heard through Video Conferencing.

2. This appeal by the accused/appellants under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act is directed against the order dated 10.05.2021 passed by the Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Mungeli, District Mungeli, C.G. rejecting their application under Section 438 Cr.P.C. The

appellants filed this appeal as they were apprehending their arrest in connection with Crime No.76/2021 for the offence punishable under Sections 186, 353, 332, 294, 506-B, 323, 269, 188, 270, 147, 148 of Indian Penal Code, Sections 3 & 4 of Epidemic Disease Act, 1897 and Section 3(1)(?k) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act registered at Police Station AJAK, Mungeli, District Mungeli, C.G.

3. Learned counsel for the appellants submits that during pendency of this appeal the appellants have been arrested by the police and as such the present appeal has become infructuous and he seeks to withdraw the same.

4. In view of above, the instant appeal stands dismissed as withdrawn for having become infructuous.
