The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 378/2015 registered in Police Station Jamul District Durg (C.G.) for offence punishable under section 454, 380 of Indian Penal Code.

As per the prosecution complainant Subhash Kumar Sinha on 26/06/2015 had left his residence alongwith his wife for their job and while his wife came back she found that lock of the house was broken and ornaments and mobile was missing. Subsequently, the applicant was arrested.

Learned counsel for the applicant submits that three gold rings has been seized from the applicant which has not been identified. He submits that other co-accused has been enlarged on bail vide M.Cr.C. No.5922/2015 on 5/11/2015, therefore, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail,

however do not dispute the fact that similarly placed co-accused has been enlarged on bail vide M.Cr.C. No.5922/2015 on 5/11/2015. 5.

I have perused the case diary. Taking into account similarly placed co-accused has been enlarged on bail vide M.Cr.C. No.5922/2015 on 5/11/2015 and applicant is in jail since 22/08/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
