This is the first bail application filed under section 439 of the Code of Criminal Procedure Code seeking grant of bail in connection with Crime No.328 of 2014 registered at P.S. Lalbagh, Distt. Rajnandgaon (C.G), for the offence punishable u/ss 420, 467, 468, 471/34 IPC.

As per the prosecution case, the applicant alongwith other co-accused in order to provide job in different government departments has collected amounts to the tune of Rs. 82 lakhs and thereafter forged appointment letters were issued to the candidates and from the applicant forged seal of the Government departments were seized.

Learned counsel for the applicants submits that the applicant has not been named in the FIR and no evidence is available against this applicant. He further

submits that the applicant is in jail since 04.12.2015 and the witnesses have been examined, therefore, he may be enlarged on bail.

Per contra, learned State Counsel opposes the bail application. He further submits that the bail applications of similarly placed co-accused Tejesh Kumar has been dismissed by the coordinate Bench of this Court in M.Cr.C.No.582/2015 on 09.02.2015. Perused the case diary and the statements.

Considering the nature of allegations against this applicant and the way in which the offence committed and further taking into the fact that the bail application of similarly placed co-accused has been rejected, I am not inclined to allow this bail petition. Accordingly, it is rejected.
