Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 30/08/2016

1. After arguing for some time, learned counsel for the petitioners would submit that the appeal preferred by respondent No.1 against the order passed by the Sub Divisional Officer (R), Saja on 26-09-2015 is pending consideration before the Additional Commissioner, Durg, therefore, the petition may be disposed of with a direction to the said Additional Commissioner to dispose of the pending appeal within one month.

2. In view of the limited prayer made at the bar, the writ petition is disposed of with a direction that the Additional Commissioner, Durg shall decide the pending appeal bearing No.1/A-16/2015-16, village Berla, at the earliest, preferably within a period of three months from today.

3. It is made clear that this Court has not expressed any opinion on the merits of the case and the appeal shall be decided by the Additional Commissioner on its own merits.
