This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.72 of 2017, registered at Police Station - Gol Bazar, District - Raipur, Chhattisgarh for the offence punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code. 2.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. No case is made out against the applicant on the basis of the material placed before the Court by the prosecution. Number of applicants in similar cases have been granted bail by the Co-ordinate Bench of this Court, hence, the applicant may also be benefited with grant of regular bail.

Learned State counsel opposes the bail application and the submissions made in this respect.

Heard counsel for both the parties and perused the case diary. 5.

The case is that the applicant applied for the posts of Librarian and teacher against the vacancies published by Jilla Panchayat, Raipur and in that the certificates of B.Lib and I.Sic which were filed found to be fake and forged on verification. The applicant could not secure any job on the basis of the said documents, but the FIR has been lodged against him. Hence, this case.

Considering the submissions made and the contents of the case diary, I am inclined to grant bail to the applicant for the reason that the similarly placed accused persons in similar cases registered against them have been granted regular bail by the Co-ordinate Bench of this Court, this application is allowed.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
