Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 07/09/2016 Learned counsel for the State would submit, on instructions received from the S.D.O. (Revenue), Raigarh, that the petitioner being a contractor for construction and maintenance of rural roads under PMGSY Scheme may not be proceeded under Section 92 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (for short, the Adhiniyam'), therefore, the S.D.O. (Revenue), Raigarh seeks permission of this Court to withdraw the impugned order. However, he would seek liberty in favour of State to pass appropriate order in accordance with law.

In view of the above, since the S.D.O. (Revenue), Raigarh is likely to recall the order impugned, there is no need of adjudication of the legality of the impugned order.
