Shri Paras Mani Shriwas, learned counsel for the applicant submits that under the provisions of Section 14(A) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the rejection of bail application from the Special Court (Atrocities), appeal will lie. He submits that he may be granted permission to withdraw this bail application filed under Section 439 of the Code of Criminal Procedure, 1973.

Accordingly, the bail application is dismissed as withdrawn with liberty to challenge the impugned order by way of filing criminal appeal.

Certified copy of the impugned order be returned to the learned counsel for the applicant on furnishing the photocopy of the same.
