The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 106/2015 registered in Police Station G.R.P. Bilaspur (C.G.) for offence punishable under section 20 (B) N.D.P.S. Act.

As per the prosecution case on 12/10/2015 on information received, applicant in railway platform, Bilaspur Station was raided and from his possession 12 kg cannabis was recovered. 3.
Learned counsel for the applicant submits that two seizure was made from 6 packets and 2 packets were sent, therefore it is not allowed legally and it is stated that it only contains 2 kg maximum as the quantity seized from different packets should have been kept separately and therefore considering the fact, applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
I have perused the case diary and the charge sheet. Perusal of the case diary and the charge sheet would show that from possession of the applicant 12 kg cannabis were recovered. Argument advanced by learned
counsel for the applicant cannot be appreciated at this stage as prima facie it appears from possession of the applicant 12 kg cannabis were recovered. Taking into document and the recovery made, considering the quantity, this court is not inclined to release the applicant on bail. 6.
Accordingly, the bail application is dismissed. Certified copy as per rules.
