The prosecutrix has been provided with audience and appearance, without disclosing her identity through the Help Desk of the District Legal Services Authority, Surajpur.

At the outset, learned counsel for the applicant submits that in view of the provision contained under Section 14-A of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the applicant is willing to exercise his right of appeal against order rejecting bail application. Therefore, he prays for withdrawal of the bail application as also prayed that certified copy of the rejection of bail order be returned.

Having considered the submission of learned counsel for the applicant and that he intends to prefer appeal consistent with the provision contained under Section 14-A of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the applicant is permitted to withdraw the bail application with the said liberty. The certified copy of the order rejecting bail application, shall be returned after retaining photocopy of the same.
