NAFR HIGH COURT OF CHHATTISGARH, BILASPUR MCRC No. 3393 of 2020 • Anil Bada, S/o Bejamin, aged about 32 years, Caste Uron, R/o Village Pogra, Police Station Raidih, District Gumla (Jharkhand) ---- Applicant
Versus
• State of Chhattisgarh, through Station House Officer, Police Chowki Lodam, Police of Police Station Jashpur, District Jashpur (CG) ---- Non-Applicant For Applicant : Shri Sanjeev Kumar Sahu, Advocate.
For Non-Applicant : Shri K.K. Singh, Govt. Advocate. Proceeding Through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 14/08/2020 :
1. The applicant has preferred this bail application for grant of bail as he is arrested in connection with Crime No.216/2018, registered at Police Station Chowki Lodam, Jashpur PS, District Jashpur for offences under Sections 363 and 370/34 of the IPC.
2. Duti Bai, mother of minor Narayan Ram, lodged an FIR on 7.10.2018 alleging that the present applicant and one Arti came to her house to allure and take away her son Narayan for the job of Security Guard at New Delhi. Victim Narayan was later on recovered from Rewadi (Haryana).
3. Reading of case diary statement of Narayan would indicate that he was
not paid any amount by his Master where he was deputed to work by the present applicant and co-accused Arti. Thus, present is a case of human trafficking of minor tribal boy who has been physically exploited by obtaining work from him without making any payment.
4. Considering the facts and circumstances of the case, this Court is not inclined to release the applicant on bail. Accordingly, the application is rejected.
