The petitioner had filed the instant MCC for restoration of MCC No.459/2016 dismissed vide peremptory order dated 12-08-2016 regarding removal of default.

Learned counsel for the petitioner fairly submits that he will remove the said default within two days from now.

On due consideration, the present MCC No.667 of 2016 is hereby allowed subject to the condition that the petitioner shall remove the default in MCC No. 459/2016 within two days from now. If such default is removed within two days, then only the said MCC shall be restored to its original number. 5.

The petition disposed of.
