(2) According to the learned counsel for the State, the order impugned dated 18.09.2015 passed by respondent No.4 i.e. Chief Executive Officer, Janpad Panchayat, Ambagarh Chowki, District Rajnandgaon is appealable before the authority immediately superior to the authority removing the petitioner from services.
(3) Learned counsel appearing for the petitioner submits that the petitioner may be permitted to withdraw the instant writ petition with liberty to file an appeal before the competent appellate authority for redressal of his grievances. (4) Liberty is granted, as prayed for.
(5) Accordingly, the writ petition is dismissed as withdrawn with the liberty as aforesaid. If the petitioner makes an appeal within a period of 30 days from the date of receipt of copy of this order, the same would be decided by the competent appellate authority within a further period of three months from the date of its receipt in accordance with law.
