1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No. 397/2015 registered at Police station Champa, Distt. Janjgir Champa (C.G) for the offences punishable under 420/34 IPC.
2. As per the prosecution case, the applicant allured the persons of village to make deposits in Guru Sai Real Estate Company on the assurance that the amount will be doubled within a short period. Consequently, several persons of the village deposited the amounts at the instance of the applicant.
3. Learned counsel for the applicant submits that the applicant himself is the victim as he along-with his other family members have deposited the amounts in Guru Sai Real Estate Company and consequently he has asked other people to deposit the amount in the said Company and he has not been benefited anything from the company rather he was a loser, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the prayer for grant of bail.
5. Perused the case diary and other statements. It appears that the investigation is still in initial stage wherein recoveries of different documents are yet to be made. Considering the stage of investigation, I am not inclined to release him on bail, at this stage. Accordingly, the bail application is dismissed. Sd/- GOUTAM BHADURI JUDGE Rao
