1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.351/2019 registered in Police Station Basantpur, District Rajnandgaon, C.G. for the offence punishable under Sections 341, 307, 325 of the I.P.C. ; Sections 25, 27 of the Arms Act and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes ( Prevention of Atrocities) Act, 1989.

3. Case of the prosecution, in brief, is that applicant fired at the complainant who is working as Peon in the Pre Matric Girls Hostel. When the injured tried to save herself she sustained injuries over her left palm.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Although fired arm has been recovered from the applicant and the injuries are said to be caused by said weapon, yet considering that the applicant is in jail since last about 11 months i.e., from 15.09.2019 and the trial may take sometime due to COVID-19 pandemic situation, this Court is inclined to release the applicant on bail.

6. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of ₹50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
