1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.203/2020 registered at Police Station City Kotwali, District Durg (CG) for the offence punishable under Sections 457 and 380 of the IPC.

3. The applicant and co-accused Manoj Pardhi committed theft of

MCRC No. 3399 of 2020 ornaments and cash amounting to Rs.1,09,900/- from the house of the complainant during the intervening night of 7th and 8th of March 2020.

4. The applicant has been arrested on 9.3.2020 and the charge sheet has already been filed. The concerned SHO has not reported previous antecedents of having committed similar nature of crime.

5. Considering that the offences are triable by the Judicial Magistrate First Class and the applicant is in jail since last more than 5 months, I am of the opinion that present is a fit case in which the applicant should be released on regular bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
