The applicant has preferred this application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.78/2021 registered at Police Station- Sariya, Raigarh, C.G. for the offence punishable under Sections 109 of Indian Penal Code and Sections 34(2) and 59(A) of the C.G. Excise Act.

3. Learned counsel for the applicant submits that he does not want to prosecute this bail application and seeks to withdraw the same.

4. Permission granted.

5. Accordingly, the application MCRCA No.615 of 2021 is dismissed as withdrawn.
