This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 345/2015, registered at Police Station - Simga, District - Baloda Bazar, Bhatapara (C.G.) for offence punishable under Sections 452,294,506 of Indian Penal Code.

Case of the prosecution, in brief, is that on 30.10.2015 at about 8.20 PM Saroj Bai, Kanya Bai and Durpati Bai were sitting in their house at that time the applicant came with a tabble and abused. Thereafter the applicant entered into the room of Pandit and used filthy language to the Pandit who narrated the Bhagwat. Therefore, the matter was intervened by the ladies of the village. Thereby, the offence is committed.

Counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that no injury actually was inflected by the applicant, therefore, the applicant may be given the benefit of anticipatory bail.

State counsel opposes the prayer for grant of anticipatory bail. 5.

Having regard to the fact and circumstances of the case and considering the documents, primafacie, the allegation has been attributed to this applicant, this Court is of the opinion that it is not a fit case where the applicant can be extended the benefit of anticipatory bail. 6.
