NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WP No. 2203 of 2003 • Virendra Billaiya, Son of Shri Shrikrishna Billaiya, aged 45 years, Occupation Executive Engineer in Deputation, Rural Engineering Services, Raipur Division, Resident of F-6, Civil Lines, Raipur. ---- Petitioner
Versus
• State Of Chhattisgarh, through the Secretary, Ministry of Panchayat & Rural Development, DKS Bhawan, Raipur (CG) ---- Respondent For Petitioner : Shri BP Sharma, Advocate.
For Respondent/State : Shri Sudeep Verma, Deputy GA. Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 18/02/2019 :
1. The present Writ Petition is connected with WP No.2210/2003, however, both the matters are different. Therefore, both the Writ Petitions are taken up for hearing separately.
2. The petitioner has assailed the legality and validity of the order of suspension, which has already been revoked vide Annexure-R/3, dated 19.9.2003. The petitioner is also aggrieved by his repatriation to the parent department i.e. Chhattisgarh State Electricity Board. However, since after filing of the Writ Petition, more than 16 years have elapsed and much water has flown in respect of the petitioner's service career, therefore, for the present, the Writ Petition appears to
have been rendered infructuous.
3. Accordingly, the Writ Petition is dismissed as infructuous reserving liberty in favour of the petitioner to move afresh, if cause of action or any part thereof survives.
