Heard Learned counsel for the petitioner do not want to press the application for condonation of delay in filing the petition. Accordingly, the application for condonation of delay is dismissed as not pressed.

Heard on petition under Section 482 of Cr.P.C. for restoration of CR.M.P. No.451/216, which was dismissed in default on 31.01.2018.

On due consideration and for the reasons stated in the petition, which is supported by an affidavit and appears to be justified, to decide the case on merit, the order dated 31.01.2018 passed in CRMP No. 451 of 2016 is recalled. Consequently, the CRMP No.451 of 2016 is restored to its original number. In view of the above, the petition filed under Section 482 of Cr.P.C. for restoration of CRMP No.451 of 2016 is allowed.
