The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No. 206/2015 registered in Police Station Moudhapara Dist: Raipur (C.G.) for offence punishable under section 34 (2) of Excise Act.

As per the prosecution case applicants were found to be in possession of 6.480 bulk liters of liquor and the applicants were arrested on 4/12/2015.

Learned counsel for the applicants submits that applicants have been falsely implicated in this case and they are in jail since 4/12/2015, therefore the applicants may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail and submits that against applicant No.1 Sanjay Raksel, 5 cases have been registered under the different sections of IPC in the year 2015 bearing Crime Nos.197/2015, 57/2015, 75/2015, 202/15 and 203/15 at PS Moudhapara and against applicant No.2 Sumit Raksel, 12 cases have

been registered under different sections of IPC, out of which two cases are of year 2015 bearing Crime Nos.202/2015 and 203/2015 registered at PS Moudhapara.

Considering the severe criminal background of these applicants, this court is not inclined to release the applicants on bail. 6.

Accordingly, the bail application is dismissed. Certified copy as per rules.
