1. Learned counsel for the petitioner would submit that by efflux of time, this petition has become infructuous. However, he prays that the petitioner may be given liberty to move a regular bail application before appropriate forum.

2. The issue raised in this petition whether interim bail application without filing the bail petition under Section 439 of Cr.P.C., is maintainable or not will be decided in an appropriate case at appropriate stage.
