The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 219/2015 registered in Police Station Sitapur, District-Sarguja, (C.G.) for offence punishable under section 354 of Indian Penal Code & Section 8 of Protection of Children from Sexual Offences Act 2012.

As per the prosecution case on 14/10/2015 victim had gone to school while she was coming back applicant on her way caught hold of her hand and forced her to sit beside him in the border of the field and stated that he wanted to marry the victim. Said fact was reported to the police and offence is registered.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and no overt act has been committed by the applicant and charge sheet in this case has been filed, therefore applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Having considered the facts and circumstances of the case, degree of allegation, charge sheet having been filed and applicant is in jail since 15/10/2015, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
