The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.392/2018, registered at Police Station Mohan Nagar, District Durg (CG), for the offence under Sections 376, 506 of the Indian Penal Code. 3.
Applicant has allegedly committed forcible sexual intercourse with the prosecutrix, aged about 28 years.

The applicant was directed to be released on bail by the trial Court vide order dated 10-12-2018. In compliance of which he submitted bail bonds and was released on 3-1-2019. Due to his non-appearance before the trial Court on 28-6-2019 his bail bonds were cancelled and warrant of arrest was issued. In execution of which he has been arrested o 1-3-2021 and since then he is in detention.

Considering the entire facts situation of the case, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- with two local sureties in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
