The applicant, who is juvenile, has filed this first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to him who has been arrested in connection with Crime No.202/2015, registered at Police StationKotwali, District-Rajnandgaon (CG), for the offence punishable under Sections 459, 323, 377, 506 and 427/34 of the IPC. 2.
The applicant, being a juvenile, has a remedy of making an application for bail before the Juvenile Justice Board and thereafter appeal under Section 52 and revision under Section 53 of the Juvenile Justice (Care and Protection of Children) Act, 2000 (hereinafter referred
to as "the Act of 2000") 3.
In view of remedy available under the provisions of the Act of 2000, I am not inclined to entertain this bail application. It is accordingly dismissed with liberty to avail the remedy available under the provisions of the Act of 2000.
