1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.88/2021 registered at Police Station Nandini Nagar, District Durg for the offence punishable under Sections 407, 419, 420, 467, 468, 471, 34 of the IPC.

3. As per the prosecution case, Tata LPD vehicle belonging to complainant Jageshwar Bharti was provided for hiring with the

MCRC No. 4011 of 2021 assistance of the accused persons, however, by forging the signature of the owner of the vehicle, an agreement to sale was executed in favour of one Komal Bharti. The vehicle was recovered from the parking place of Transport Nagar, Bhilai and not from the possession of the present applicant. The coaccused has already been released on bail by the Sessions Court.

4. Considering that the applicant is in jail since 28.2.2021; the offences are triable by the Judicial Magistrate First Class; and the charge sheet has already been filed, this Court is inclined to release the applicant on regular bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
