Agrawal Order On Board / 12 /2015 Heard (1) The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 41/14 registered at Police Station Janakpur, District Baikunthpur-Koriya (C.G.) for the offences punishable under Sections 363, 366(A), 368, 376(2)(g), 342, 372, 373 & 370/34 of the Indian Penal Code and Sections 4 & 6 of Protection of Children from Sexual Offence Act, 2012 has been mentioned but in the impugned order dated 5.3.2015 only 363,366,368, 376 (2)(g) 342 of IPC and Sections 4 & 6 of Protection of Children from Sexual Offence Act, 2012.
(2) The applicant's first bail application has been dismissed on merits by order of this Court dated 31.03.2015 passed in M.Cr.C. No.1438/2015.
(3) Having heard learned counsel appearing for the parties, having regard to the facts & circumstances of the case, I do not find any change in circumstances to entertain this second bail application. Thus, the second bail application is rejected. Certified copy, as per rules.
