The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 422/2015 registered in Police Station Bhilai-3, District-Durg (C.G.) for offence punishable under section 4, 5, 10 of Krishak Pashu Parirakshan Adhiniyam 2004. 2.

As per the prosecution case on 7/10/2015 it was reported that applicant is in possession of 3 kg beef in his house and subsequently raid being made the beef was recovered from possession of the applicant and he was arrested.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and the mutton which was kept it was not the beef, charge sheet has been filed and applicant is in jail since 7/10/2015, therefore applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Having considered the facts and circumstances of the case, degree and level of allegation made against this applicant and further taking into fact that charge sheet in this case has been filed and applicant is in jail

since 7/10/2015, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. 7.

Further taking into memorandum statement that applicant is working at Saudi Arab he is further directed to surrender his passport before the court till case is pending.
