This is an application under Section 438 of CrPC for grant of anticipatory bail to the applicant as he apprehends his arrest in connection with Crime No.38 of 2021 registered at Police Station- Vishrampur District- Surajpur Chhattisgarh for commission of offenses punishable under Sections 294, 323, 457, 506 and 34 of IPC.

Shri Shakti Raj Sinha, learned counsel for the applicant seeks permission of this Court for withdrawal of bail application. He further submits that applicant is a student and participating in UPSC Examination. In support of his submission, he has submitted document showing status of application and also details of UPSC Examination. He prays for a direction to the Court below to consider the application for grant of regular bail upon surrender of applicant on the same day.

Shri Sudhir Sahu, learned State counsel submits that he has no objection to the prayer made by learned counsel for the applicant.

In view of above, MCRCA-643 of 2021 is dismissed as withdrawn. 5.
Learned Court below may consider and decide the regular bail if filed by the present applicant after his surrender, on the same day, in accordance with law.
