The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.423/2019, registered at Police Station City Kotwali, Mungeli, District Mungeli (C.G.) for the offence punishable under Sections 379 & 429 read with Section 34 of IPC, Section 11 of the Prevention of Cruelty to Animals Act and Sections 4 & 6 of the Chhattisgarh Agricultural Cattle Preservation Act. 2.
The accused persons have committed theft of 15-20 numbers of cows and were transporting the same in a truck in very cruel manner, because of which 4 cows died during transportation.

Admittedly, the co-accused Jeevan Patel, Satish Patel and Manuk Patel have already been released on regular bail vide order dated 06.09.2019 in MCRC No.5490/2019.

Learned State counsel would oppose the prayer for grant of bail. 5.
Considering the release of similarly placed co-accused persons on bail, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
