This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.221/2015, registered at Police Station - Ramanujnagar, District - Surajpur (C.G.) for the offence punishable under Section 20 (B) Narcotics Drugs and Psychotropic Substances Act.

Case of the prosecution, in brief, is that the applicant was found in possession of 6 kg and 50 gram of cannabis and thereafter the applicant was arrested on 22.10.2015.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He would further submit that the cannabis were seized from the Varanda and not in the conscious possession of the applicant. He would further submit that charge-sheet in this case has been filed and the applicant is on jail since

Page No.2 22.10.2015, therefore, the counsel prays that the applicant may be released on bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties and perused the case diary.

I have perused the statement of the witnesses and the documents, which prima-facie shows that seizure was made from the possession of the applicant. Considering the quantity of the cannabis i.e. 6 kg and 50 grams, I am not inclined to release the applicant on bail. 7.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
