Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 30/05/2018 Heard.

1. The applicant has been arrested on allegation of having committed offence under Section 419, 468, 469, 471, 34 of the IPC in connection with Crime No.17/2018 registered at Police Station- Basantpur, Chouwki - Wadrafnagar, District Balrampur-Ramanujganj (CG).

2. The prosecution case is that co-accused Vishal Patel impersonating as Govt. official threatened the complainant to take action against certain alleged illegal appointments. The allegation against the applicant is that the coaccused used to mention the name of the present applicant as the person on whose behest action is proposed to be taken.

3. Learned counsel for the applicant would submit that the investigation is complete, charge-sheet has been filed and the applicant does not have any criminal antecedent. The applicant has been involved only on the ground that co-accused Vishal Patel extended threat by impersonation mentioning that it is at the behest of the applicant. Therefore, he may be granted bail.

-24. Learned counsel for the State submits that in view of the statement of the coaccused, a case against the present applicant is also made out.

5. Taking into consideration nature of the allegation, role alleged to be played by the applicant and that he is in jail since 12.02.2018, investigation is complete, charge-sheet has been filed, he is not likely to abscond or tamper with the prosecution witnesses, the application is allowed.

6. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- along with one surety for the like amount to the satisfaction of the Court below with following further conditions:

(i) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial; and (ii) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. Certified copy as per rules.
