Learned counsel appearing for the petitioner would submit that order is appealable before the Secretary, Woman and Child Welfare Department, State of Chhattisgarh, Raipur and therefore, the petitioner may be permitted to prefer an appeal before the Appellate Authority. 2.

The prayer appears to be fair and reasonable.

If the petitioner prefers an appeal before the Appellate Authority within a period of three weeks from today, then the Appellate Authority would do well and dispose of the appeal and would also consider the judgment of the Supreme Court in the matter of Ajay Kumar Choudhary Vs. Union of India through its Secretary and Anr. (2015) 7 SCC 291 in accordance with law on its own merit as early as possible preferably within a period of two months from the date of presentation of the appeal. 4.

With the aforesaid observation, the writ petition stands disposed of. No order as to cost(s).
