The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody since 17.09.2017 in connection with Crime No.70/2017 registered at Police Station : Baradwar, District Janjgir-Champa (C.G.) for the offence punishable under Sections 376(2), 315 IPC, Section 6 of Protection of Children from Sexual Offence Act and Section 3 (2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 2.

Considering the statement of the prosecutrix wherein she admitted to have an affair with the applicant and for the reason that after their physical relation, she agreed to abort the pregnancy and used medicine brought by the applicant as also considering the delay in lodging the FIR, this Court is

inclined to release the applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond of Rs.25,000/- with one surety for the like sum to the satisfaction of the concerned Court for his appearance before it as and when directed.
