The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody since 17.01.2018 in connection with Crime No.16/2018 registered at Police Station : Jaijaipur, District Janjgir-Champa (C.G.) for the offence punishable under Section 20 (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The applicant was found transporting illicit cannabis weighed about 4 kg. At the time of incident, the applicant and two other accused persons were moving on motorcycle. The motorcycle, which was being driven by the applicant, was found carrying 4 kg cannabis in the dicky. From co-accused Ekadashiya Satnami and third accused Raghunandan Giri Goswami, 6 kg and 2 kg cannabis have been recovered from
them respectively.

Considering the fact that the applicant is in jail since 17.01.2018 and that no previous criminal antecedent of his involvement in committing similar nature of crime is there, this Court is inclined to release the applicant on bail. 4.
Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond of Rs.25,000/- with one surety for the like sum to the satisfaction of the concerned Court for his appearance before it as and when directed.
