(2) This petition has been preferred by the petitioner against the impugned order dated 09.09.2016 (Annexure P/1) passed by respondent No.2-Under Secretary, Department of School Education, State of Chhattisgarh, Raipur placing the petitioner under suspension from the post of Principal, Government Girls

Higher Secondary School, Sakti in exercise of Rule 9(1)(A) of the Chhattisgarh Civil Services (Classification, Control & Appeal) Rules, 1966.

(3) Learned counsel appearing for the petitioner submits that the order of suspension is appealable before the appellate authority and, therefore, he may be permitted to prefer an appeal before the appellate authority within a period of 15 days from today.

(4) Prayer appears to be fair and reasonable.

(5) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of 15 days from today and, in turn, the appellate authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of 45 days from the date of receipt of appeal of the petitioner along with copy of this order.

(6) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
