1. The grievance of the petitioner in the present writ petition seems to be the inaction on the part of the respondents in not granting the benefit of third time bound pay scale on completion of 30 years of service.

2. According to the petitioner he has already received first as well as second time bound pay scale and undoubtedly he has already completed 30 years of service. It is also the contention of the petitioner that department where the petitioner is working had already recommended the claim of the petitioner for third time pay scale but though benefits have been extended to many other similarly placed persons but for no reason benefit to the petitioner has not been extended. Counsel for the petitioner submits that

-2he has got only around 10 months of service left for his retirement and he has been approaching the department by way of various representations and reminders for the release of the third time bound pay scale but till date the authorities have not taken any decision.

3. Learned State counsel on the other hand submits that since his claim has not been either rejected by the respondents, let matter be disposed of directing the respondent no.2 & 3 to take a decision in this regard.

4. Given the facts and circumstances of the case, particularly, considering the fact that petitioner has completed 30 years of service and also taking note of the fact it is only 10 months left for the petitioner to retire. The writ petition at this juncture stands disposed of directing the respondent no.2 & 3 to take a decision on the claim of the petitioner for third time bound pay scale.

5. Let appropriate decision be taken by the respondent no.2 & 3 at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.
