Versus
1. Mr. Rajesh Singh Rana, Collector Balod, District Balod, Chhattisgarh.
2. Mr. Sameer Pandey, District Programme Officer, Women & Child Development Department, Devari, District Balod, Chhattisgarh. ---- Respondents/ Contemnor --------------------------------------------------------------------------------------------------- For Petitioner : Mr. T.K.Tiwari, Advocate --------------------------------------------------------------------------------------------------- Hon'ble Shri Justice Goutam Bhaduri Order On Board 18.10.2016 Heard 1.
The instant contempt petition is for the reason that initially the interim protection was granted to the petitioner by an order dated 30.06.2016 wherein the transfer affected with respect to the petitioner was stayed. Subsequently, the contempt petition was filed that she was not allowed to join and the said petition i.e. Contempt Case (C) No. 334/2016 was withdrawn on 08.08.2016 wherein it was stated that the order has been complied. 2.
Learned counsel for the petitioner submits that the petitioner has not been given the salary, therefore, the intention of the contemnor has to be seen that they are bypassing the order of the Court and the necessary notices may be issued.
3.
Perused the order dated 30.06.2016. The said order only speaks about stay of the transfer with respect to the petitioner. The order do not speaks about any payment of salary. If the petitioner has any grievance about the payment of salary, the petitioner may avail the other remedy which may be available to him. The contempt petition cannot be stretched to the extent to cover the grievances raised by the petitioner.
4.
In the result, I am not inclined to entertain this contempt petition. Accordingly, the petition is dismissed at the admission stage itself. Sd/- (Goutam Bhaduri) Judge Ashok
